Campus Sexual Misconduct: New Guidance and Updated Title IX Requirements

On September 22, 2017, the U.S. Department of Education rescinded guidance from the previous administration and issued a new “Q&A on Campus Sexual Misconduct.” While there are a few areas that remain similar in the new guidance, the new document differs substantially from the guidance issued by the previous administration in a number of key areas, particularly with regards to Title IX requirements and responsibilities.

In this session, Attorney Erin D. Gilsbach will provide a detailed analysis of the new guidance as well as information that schools need to know with regards to sexual harassment/misconduct investigations and their obligations under Title IX. She will also provide best-practice tips for conducting successful and complaint investigations, establishing a uniform burden of proof, as required in the new Q&A, and ensuring that both the victim and the accused receive a fair and unbiased process expected of them.

Erin D.
