DHS Latest Modifications in I-9 and E- verify Compliance Rules

On May 14, 2020, the U.S. Department of Homeland Security's (DHS) Immigration and Customs Enforcement (ICE) agency announced an extensionof its prior guidance relaxing the in-person verification requirements of Form I-9 for employers operating remotely due to the COVID-19 pandemic. The initial guidance became effective on March 20, 2020, and was scheduled to expire after 60 days on May 19, 2020. ICE has now indicated that due to continued precautions related to COVID-19, this policy will be extended for an additional 30 days.


In addition, ICE announced that employers that had been served notices of inspection (NOIs) during March 2020 and been previously granted automatic 60-day extensions until May 19, 2020, to respond to such NOIs, would be granted an additional 30 days to respond to the NOIs, if they had not done so already.


The Department of Homeland Security (DHS) issued temporary changes to the I-9 verification process for virtual verification, the DHS recently issued a temporary policy to allow employers to accept expired List B documents when completing the Form I-9 beginning May 1.This updated policy is intended to account for the fact that many people are unable to renew their driver’s licenses or state ID cards at this time due to stay-at-home orders. While some states have extended the expiration of drivers’ licenses and state identification cards, which are common List B documents, others have not. The temporary policy addresses both situations.

Matthew Burr is a SHRM Certified Exam Instructor and co-teaches the SHRM Exam Prep Course at Elmira College. He is an Adjunct Professor at Corning Community College and Elmira College; teaching Organizational Behavior and Effective Negotiations, along with developing curriculum for a Workplace Readiness course. 

Matthew holds a master's degree from the University of Illinois, School of Labor and Employment Relations in Human Resources & Industrial Relations, a Lean Six Sigma Green Belt certification, both the SPHR and SHRM-SCP, a bachelor's of science degree from Elmira College and an associate's degree in Business Administration from Tompkins Cortland Community College.  He has also made publications at the Cornell HR Review and Business Insider.

Matthew has several years of experience working in the human resources field and has founded a human resources consulting company; Burr Consulting, LLC. He started his career as an Industrial Relations Intern at Kennedy Valve Manufacturing.  Matthew is currently working towards a master’s degree in business administration through Syracuse University.
