At one time, employers easily terminated employees for being “under the influence of marijuana.” While marijuana remains an illegal drug in the United States, twenty states and the District of Columbia (and counting) have decriminalized possession of marijuana for medical use. Some states even allow it for recreational use. The uncertainty of how to deal with marijuana makes it very difficult for employers who must deal with the different laws while continuing to ensure that they are providing a safe work environment for their employees. Given an employers’ obligation to accommodate disabilities under the Americans with Disabilities Act, can an employer continue to enforce drug policies against employees’ use and what about state laws that protect employees’ lifestyle?
